Office Depot Specialist, HR Compliance in Boca Raton, Florida

The HR Compliance Specialist is responsible for administering various functions, to include serving as a subject matter expert on all compliance issues related to the human resources function. This position is primarily responsible for administering the severance agreement process and outplacement program for exiting associates, maintaining background and DMV compliance reports, overseeing wage and hour compliance and analyzing reports for management review, and monitoring repayment agreement compliance, preparing appropriate notices when non-payment occurs. The HR Compliance Specialist will also serve as a liaison for HR Business Partners enterprise-wide for LOA escalation, reduced schedule pay, and intermittent FMLA pay. Additionally, the HR Compliance Specialist will partner with HR and legal teams to support process improvement and compliance initiatives.

Primary Responsibilities:

  1. Manages full life-cycle of the severance agreement process for exiting associates, including but not limited to, preparing severance agreements in compliance with federal and state laws and distributing to impacted associates; maintaining and updating severance package information, including compliance documentation for ADEA, benefits, and FAQs; managing revocation period calendar; ensuring RIF checklist is approved by HR Leadership and Legal counsel and responsible to maintain copies of the documents. Communicates with impacted associates post-employment, manages the receipt of all signed General Releases, partners with Payroll to ensure the timely processing of payments. Responsible for providing severance accruals and audits to Finance. Responsible to upload associate's information to Equifax CaseBuilder, so that Equifax has all the information needed for unemployment claims.

  2. Responsible for day-to-day responsibilities with 3rd party vendors for background/drug screening, leave of absence, outplacement services and federal, state and local law poster compliance.

  3. Primary contact and coordinator with 3rd party leave of absence (LOA) provider to update leave of absence letters in partnership with in-house legal counsel and navigate escalation/investigation issues.

  4. Create training programs and materials and facilitate in HR training meetings and lead ad hoc projects as needed for LOA escalations and investigations to ensure compliance with the FMLA, ADA and state and local leave laws.

  5. Handles LOA reduced schedule pay/intermittent FMLA pay, in coordination with Payroll processing

  6. Coordinates repayment of sign-on and relocation bonuses and overpayments owed by former associates, in conjunction with Payroll processing

  7. Responsible for maintaining and updating FCRA pre-adverse and adverse letters and adjudication guidelines and complying with state and local fair chance legal requirements. Serves as 2nd level escalation for backgrounds, analyze and adjudicate complex background check requirements and results.

  8. Responsible to coordinate with Payroll on immediate pay and penalty pay.

  9. Partners with HR Compliance and Audit team to ensure termination are keyed appropriately and timely. Also, responsible to work with HR Compliance and Audit to reinstate an associate in the HR System based on Problem Resolution Process or other investigation. Coordinates updates with the Benefits Team to ensure associates are not adversely affected.

  10. Performs other job-related duties, as assigned by the Sr. Manager, HR Shared Services

    Education & Experience

    Level of Formal Education:

    Bachelors degree or equivalent experience

    Area of Study:

    Business, Human Resources, and/or Legal

    Years of Experience:

    Minimum 4 year experience in related field

    Type of Experience:

    HR and/or Legal Compliance, HR Operations, HR Shared Services or HR Generalist

    Special Certifications: (CPA, Etc.)

  11. PHR preferred

    Language Skills:

  12. English

    Technical Competencies:

  13. Microsoft Office Suite, HR systems

    Skills and Ability:

  14. Strong knowledge of federal, state, and local laws pertaining to HR/Employment Policies.

  15. Knowledge of state and federal FMLA regulations, ADA and COBRA requirements, typical hiring and termination practices and procedures

  16. Strong analytical and problem-solving skills.

  17. Strong ability to identify efficiencies, automate and streamline processes.

  18. Ability to interact with all levels of an organization. Ability to build internal and external relationships and provide excellent customer service.
